Terms of service
Draft — not yet reviewed by a lawyer.
These terms are an agreement between you and Plexus Labs ([address]) ("we", "us") about your use of simmail, including the website at simmail.dev, the platform where you sign in, the simulated mail servers, the API and the MCP endpoint (together, "the service"). If you use the service for an organization, you agree for that organization and confirm you can.
1. What simmail is
simmail is a simulated email service for testing software. Your apps send and read mail in "universes", and simulated people, written partly by AI, react to it. simmail does not deliver mail to real mailboxes. It is a testing tool, not an email provider, and you should not rely on it to send, store or archive real correspondence.
2. Your account
- You need an account to use the hosted service. Give accurate details and keep your password, API keys and app logins safe. You are responsible for what happens under your account.
- Accounts belong to organizations. Owners control the organization's plan, members and data.
- You must be at least 18, or the age of majority where you live, to create an account.
3. Plans and limits
Each organization is on a plan that sets limits (such as AI actions, mail received, people and retention) and features. The current plans are on the pricing page, and how limits work is in the docs. When you reach a limit, the service behaves as described there, for example replies switch to templates when AI actions run out.
Every organization starts on the Free plan; a paid plan starts when you subscribe to it. We may change plans, prices, limits and features over time. If a change reduces what you have already paid for, it applies from your next billing period, and we will tell you in advance.
4. Payment
Paid plans are sold through Polar (polar.sh), which acts as the merchant of record. Polar processes your payment, issues invoices, handles sales tax and VAT, and manages cancellation and refunds under its own terms. Subscriptions renew automatically each month or year until cancelled. If you cancel, you keep your plan until the end of the period you paid for, then move to Free. Unless the law requires otherwise or we agree with you in writing, payments are not refundable.
5. Your content
"Your content" is what you or your apps put into simmail: mail, attachments, personas, settings and the like. You keep all rights to it. You give us permission to store, process and display it only as needed to run the service for you, including sending parts of it to our AI provider so simulated people can read and answer it. We do not sell your content.
You are responsible for having the right to put your content into simmail. Please use test data. See the acceptable use policy and the privacy policy.
6. Retention and deletion
Mail and activity are kept for as long as your plan allows, or less if you choose. Older data is removed automatically. You can delete a universe, and everything in it, at any time. If your account is closed, we delete your organizations' universes; some account and billing records may be kept as the law requires.
7. Acceptable use
You agree to follow the acceptable use policy. We may suspend or limit an account that breaks it, puts the service or other customers at risk, or is used to break the law. Where we reasonably can, we will tell you first and give you a chance to fix the problem.
8. AI-generated content
Replies, personas, stories and inbound mail written by simulated people are generated by AI and by templates. They are fictional, can be wrong or odd, and are not statements by us. Do not treat them as real advice or as the views of any real person.
9. Availability and changes
We work to keep simmail running but do not promise any specific uptime unless we agree a service level with you in writing. We may change, add or remove features. If we stop offering the hosted service entirely, we will give you reasonable notice so you can retrieve your content.
10. Disclaimers
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Test results, spam scores, health reports and deliverability scores are estimates and do not guarantee how real mail providers or people will behave.
11. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim, or $100 if that is more.
12. Ending the agreement
You can stop using simmail and delete your organization at any time. We can end these terms or close an account for a serious or repeated breach, or with 30 days' notice for any other reason. Sections that by their nature should survive (such as payment owed, disclaimers and limitation of liability) survive.
13. Changes to these terms
We may update these terms. For material changes we will give notice, for example by email or in the dashboard, before they take effect. Continuing to use the service after that means you accept the new terms.
14. General
These terms are governed by the laws of [state], United States, without regard to conflict-of-laws rules, and disputes will be heard in the courts of [county, state]. If part of these terms is unenforceable, the rest still applies. These terms, the policies they link to and any order you accept are the whole agreement between us about the service.
